Professional standards are a new type of documents that systematically represent up-to-date information on the requirements for the qualifications necessary to perform certain types of labor activity. Occupational standards (PS) began to be developed in Russia in the mid-1990s. The initiators of their creation were representatives of the business community. As part of the implementation of the Agreement on interaction between the Ministry of Education and Science of Russia and the Russian Union of Industrialists and Entrepreneurs (RUIE), the developed and approved professional standards were recommended to be used when creating the corresponding state educational standards and professional educational programs... Taking into account the significant share of state structures and organizations with state participation in the Russian economy, in 2012 a political decision was made on the active participation of the state in the development of the national qualifications system. Today, the creation of professional standards is coordinated by the Ministry of Labor of Russia. Draft standards can be developed by associations of employers, employers, professional communities, self-regulatory organizations and other non-profit organizations with the participation of educational organizations vocational education and other interested organizations. The methodology for developing professional standards provides for their broad public discussion. Thus, the public format for the development of professional standards was replaced by the state-public one. At the end of 2015, about 800 professional standards had been adopted, but the developers plan to approve about 1200 professional standards. Professional standard of a pedagogical worker: basic provisions

The professional standard of a teacher of additional education contains:

The professional standard of the teacher of additional education 2016 allows teachers who have passed compulsory or voluntary certification to work.

According to order No. 613n, the following requirements are imposed on the training and education of a pedagogical worker:

"Secondary vocational education - training programs for middle-level specialists or higher education- bachelor's degree, the direction (profile) of which, as a rule, corresponds to the direction of the additional general education program, mastered by students, or taught training course, discipline (module).

Additional vocational education - professional retraining, the direction (profile) of which corresponds to the direction of the additional general education program, mastered by students, or the taught course, discipline (module).

In the absence of pedagogical education - additional professional pedagogical education; an additional professional program can be mastered after employment. Training on additional professional programs by profile teaching activities at least once every three years ”.

The professional standard of the teacher of additional education in 2016 regulates the activities of the employee until 01.01.2017.From the beginning of next year, different norms will begin to apply.

Professional standard: the need for implementation

The Ministry of Justice of the Russian Federation has developed a professional standard due to the difficulties that have arisen in the process of determining the qualifications of a teacher. Some of the legislation was passed over 20 years ago. They are no longer relevant. To meet global trends, new standards are being introduced.

The norms adopted at the legislative level will help to increase the responsibility and interest of employees. To ensure that they are fully implemented, it is recommended to send employees to refresher courses.

Competent use of the standard

To achieve high results, you must adhere to the following rules:

    Do not use the professional standard as a strict regulation of the work of employees.

    Do not force employees to do work that distracts them from their direct responsibilities.

    Encourage employees to seek out-of-the-box solutions.

According to the professional standard, a teacher is obliged to:

    Develop measures to improve the equipment of the classroom.

    Advise children and their parents.

    Help students, control them.

    Correct the behavior of children.

In order for the educational process to proceed according to the standard and at the same time in an unconventional way, the teacher of additional education must have the following personality traits:

    Tolerance of beliefs.

According to the changes introduced this year to the Federal Law No. 273 "On Education in the Russian Federation" in 2017, each teacher of additional education must pass compulsory certification. This procedure shows the degree of skill of the employee. Pedagogical worker must necessarily provide evidence of their achievements: gratitude, diplomas, diplomas. Based on the results of certification, he is assigned one or another qualification category. The result of the certification can be challenged in court. Also, a special labor commission can be created to resolve the issue.

The minor changes that happened in 2016 are not problematic. Everything is clear and doable. Heads of centers and municipal institutions for additional education for children should prepare by January 1, 2017. In addition, no one requires the teacher, for example, to correct complex deviations in the child's behavior, but his main task is to be able to recognize certain problems in time (whether it is a developmental delay or mental retardation or just attention deficit) in order to refer the child to the right specialist. Therefore, one of the main requirements of the standard is the ability to interact with other specialists: psychologists, social educators, defectologists, etc.

Requirements of the standard for the education of teachers

Requirements for a teacher of additional education:

higher education (bachelor's degree) or secondary vocational education in the direction of "Pedagogical education", as a rule, in the profile "Additional education (in the relevant field);

The professional standard allows, based on general characteristics activities, "recruit" the functions of an individual employee. All the functions presented should not be performed by one universal specialist. They are distributed among all employees involved in the process.

The head of the organization ensures the performance of functions due to the rational staffing, due to the improvement of the qualifications of his employees, due to the adequate distribution of areas of responsibility between them.

This approach allows us to get away from the situation of equating the qualifications of a young and an experienced teacher, assigning identical functions to them and assuming that these functions will be performed at the same level of quality.

The professional standard is a tool for the formation of a new pedagogical culture, even more so, of social consciousness. The very activity of teachers of vocational education is assessed from the standpoint of a competence-based approach - a teacher needs to be shown at the certification how he copes with professional tasks; show your knowledge in ways of doing things.

More often than not, we receive questions about the possibility of teaching a subject that is not listed in the diploma of education. The answer to it is contained in section 5 "The main consequences of the introduction of professional standards." You need to see if the specialty you received belongs to the enlarged group of specialties according to the All-Russian Classifier.

Terms of introduction of professional standards

From January 1, 2017, the Order of the Ministry of Labor of October 18, 2013 No. 544n comes into force, which approves the professional standard "Teacher" ("pedagogical activity in the field of preschool, primary general, basic general, secondary general education (educator, teacher)" ). This means that employers (heads of educational institutions) are obliged to apply it in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the conclusion of labor contracts, the development of job descriptions and the establishment of remuneration systems.

So far, it is known about two orders of the Ministry of Labor, which postpone the introduction of professional standards in the educational sphere: order No. 745 of 12/15/2016 "On Amending the Professional Standard" Teacher "(which postpones the date of entry into force on 09/01/2019) and an order of the Ministry of Labor of 12/26/2016 No. 835n "On amendments to the professional standard" Teacher of additional education for children and adults "(which postpones the entry of the professional standard to 01/01/2018). The orders, apparently, did not pass registration with the Ministry of Justice, therefore, find their texts in legal framework failed yet.

At the same time, the Decree of the Government of the Russian Federation of June 27, 2016 No. 584 establishes a transition period for all professional standards until January 1, 2020. Thus, until the beginning of 2020, the employer, in accordance with the plan for the transition to a professional standard, approved by him, selects the document that is to be used in an educational institution. By the end of the transitional period, the plans must be implemented, and all teaching staff of the educational institution must meet the requirements of the professional standard.

It refers to teachers in preschool, primary and high school, the system of special education and training.

The professional standard "Teacher" does NOT apply to teachers of additional education, educational psychologists, tutors, methodologists.

Responsibility for non-application of the professional standard

Responsibility for non-compliance with the requirements of professional standards is established by Art. 5.27 of the Code of Administrative Offenses of the Russian Federation "Violation of labor legislation and other regulatory legal acts containing norms labor law". In accordance with the provisions of the article, liability for a single violation is established in the form of a warning or the imposition of an administrative fine on officials in the amount of 1,000 to 5,000 rubles, and for legal entities from 30,000 to 50,000 rubles. In case of a repeated violation, officials may be fined from 10,000 to 20,000 rubles. or disqualification for 1 to 3 years. For legal entities, the fine is increased to 50,000 - 70,000 rubles.

Feature of the used terminology

Under the qualifications of an employee in Art. 195.1 of the Labor Code of the Russian Federation means the level of knowledge, skills, professional skills and work experience of an employee. In turn, the professional standard is a characteristic of the qualifications necessary for an employee to carry out a certain type of professional activity, including the performance of a certain labor function.

In accordance with the Decree of the Government of the Russian Federation of January 22, 2013 No. 23 "On the rules for the development, approval and application of professional standards", the Ministry of Labor and Social Protection of the Russian Federation coordinates the development of standards (clause 2). Professional standards are used by employers in the formation of personnel policy and in personnel management, in the organization of training and certification of employees, the development of job descriptions, tariffication of work, the assignment of wage grades to employees and the establishment of remuneration systems (clause 25).

Order of the Ministry of Labor dated 12.04.2013 No. 148n "On approval of qualification levels in order to develop draft professional standards" approved a description of nine levels of qualifications of employees. Level 5 (for educators) and level 6 (for teachers) apply to teaching staff.

For each labor function in the professional standard, a code number is used. It consists of two components: letter designation and digital. The letter means the generalized labor function, and the number means the labor function. The labor function, in turn, includes three components: labor actions, necessary knowledge and necessary skills. Thus, new requirements for the activities of pedagogical workers instead of the previous Unified Qualification Handbook will be established in the description of the labor function in the professional standard.

The main consequences of the introduction of professional standards

With the introduction of professional standards, the teaching of the relevant subjects and disciplines will be able to be dealt with only by those employees who were trained in the relevant areas. However, it is not entirely clear what should be understood by "direction". Some experts suggest that the direction should be understood as the exact correspondence between the direction of training and the discipline taught (a physicist will be able to teach only physics, but not computer science). Others indicate that the direction is understood as an enlarged group in the understanding of the Order of the Ministry of Education and Science of September 12, 2013 N 1059 and the Order of the Ministry of Education and Science of September 12, 2013 N 1061. That is, a person who has received an education in mathematics will be able to conduct all disciplines corresponding to mathematical and natural sciences, namely mathematics, physics, computer science, etc. Since in accordance with clause 4 of the Order of the Ministry of Education and Science of the Russian Federation (Ministry of Education and Science of Russia) dated September 12, 2013 N 1059 Moscow lists of professions, specialties and areas of training ”professions, specialties and areas of training related to one professional area, when forming the lists, are combined into enlarged groups of professions, specialties and areas of training. The enlarged group is indicated in the classifier by the 2nd and 3rd signs.)

It is highly controversial to believe that teachers primary grades will not be able to work as educators in preschool institutions and vice versa without additional retraining. First, professional standards establish the same requirements for the education and training of educators and teachers. Second, the differences between pedagogical activities for the implementation of programs before school education and the implementation of primary school curricula concerns only different work functions and skill levels.

It should be noted that in accordance with the Order of the Ministry of Labor dated August 5, 2016 No. 422n "On Amendments to the Professional Standard" Teacher ", changes have been made to the requirements for education and training. Now, for a teacher, this is higher education or secondary vocational education within the framework of the enlarged groups of directions for the preparation of higher education and specialties of secondary vocational education "Education and pedagogical sciences»Or in the field corresponding to the taught subject, or higher education or secondary vocational education and additional vocational education in the direction of activity in an educational organization. And for the educator: higher education or secondary vocational education within the framework of enlarged groups of areas of preparation of higher education and specialties of secondary vocational education "Education and Pedagogical Sciences", or higher education or secondary vocational education and additional vocational education in the direction of activities in an educational organization. Thus, the requirements were brought in line with the Unified Qualification Handbook. Thus, the widespread belief that a teacher is obliged to have an education or to undergo retraining in the field of pedagogical sciences does not correspond to latest version requirements of the professional standard.

A significant part of the activity, which was previously recorded in the Regulations on Incentives and was additionally encouraged, is now an obligatory labor function of the teacher and must be paid from the salary. So, now the teacher is obliged to possess such competencies as working with gifted children, deviant children, with those for whom Russian is not their native language, as well as competencies in the field of inclusive education. The teacher must be able to interact with other specialists: psychologists, defectologists, social workers, and also have ICT skills.

What local regulations will be amended in the process of introducing professional standards?

Regulation on certification (in connection with the entry into force of the Federal Law "On independent assessment of qualifications" and the need to conduct certification in accordance with the requirements of professional standards);

Regulations on training (in connection with the change in the labor functions of the teacher);

Regulations on bonuses (on incentives) (in connection with the change in the teacher's labor functions and the appearance among the obligatory functions of those for which incentive payments were previously assumed);

Regulations on structural divisions;

Staffing table (in connection with the requirements for the qualifications of subject teachers, teachers primary school, Russian, mathematics);

Job descriptions (due to changes in labor functions);

Labor contracts (due to changes in labor functions and remuneration).

Is it possible to fire an employee who does not meet professional standards?

Labor law provisions do not allow you to fire an employee just like that. If he does not meet the professional standard for his position, then he should be offered (if any) another position.

Also, the employer can send the employee for professional retraining. In accordance with Art. 196 of the Labor Code of the Russian Federation, training of employees and additional professional education of employees are carried out by the employer on the conditions and in the manner determined by the collective agreement, agreements, labor contracts. For employees undergoing training, the employer must create the necessary conditions for combining work with education, provide guarantees established by labor legislation and other regulatory legal acts containing labor law norms, a collective agreement, agreements, local regulations, and an employment contract. It should be noted that the Ministry of Education and Science of the Russian Federation, together with the Trade Union of Public Education and Science Workers of the Russian Federation, issued a letter No. 08-415 dated March 23, 2015 "On the implementation of the right of teachers to additional vocational education", which, in particular, indicates that "The employer does not have the right to oblige employees to carry out additional professional training at their own expense, including such conditions cannot be included in the relevant agreements." However, this letter is not regulation and is optional.

If the employee refuses to transfer to another position or undergo retraining, then until January 2020 nothing can be done with the employee. At the same time, with the end of the transitional period, all employees in positions of teaching staff must meet the requirements of the professional standard. Thus, from January 2020, an employee can be sent for an independent assessment of qualifications in order to obtain a certificate of conformity (the Federal Law "On independent assessment of qualifications" comes into force on January 1, 2017).

An independent assessment of qualifications, if carried out in the direction of the employer, is carried out at the expense of the employer by the qualifications assessment center. The specific procedure for conducting the assessment is approved by the Decree of the Government of the Russian Federation of November 16, 2016 N 1204 "On Approval of the Rules for an independent assessment of qualifications in the form of a professional exam" by the qualifications assessment center. Within thirty days, the applicant is issued a certificate of qualification (in case of successful passing of the exam) or a conclusion on passing the qualification exam (in case of unsuccessful passing of the exam). At the moment, certificates of qualification are of an indefinite nature.

Thus, if, based on the results of an independent assessment of qualifications, an employee received a certificate of conformity, then he cannot be dismissed from the organization on the basis of non-compliance with professional standards. At the same time, one should not confuse the concepts of “attestation for compliance with the position held” and “attestation for compliance with a professional standard”. If the teacher does not pass an independent qualification assessment, then he may be dismissed under Art. 81 h. 3 "due to insufficient qualifications, confirmed by the results of certification."

The professional standard of the teacher of additional education 2016 allows teachers who have passed compulsory or voluntary certification to work.

According to order No. 613n, the following requirements are imposed on the training and education of a pedagogical worker:

“Secondary vocational education - training programs for middle-level specialists or higher education - bachelor's degree, the direction (profile) of which, as a rule, corresponds to the direction of the additional general education program, mastered by the students, or the taught curriculum, discipline (module).

Additional vocational education - professional retraining, the direction (profile) of which corresponds to the direction of the additional general education program, mastered by the students, or the taught course, discipline (module).

In the absence of pedagogical education - additional professional pedagogical education; an additional professional program can be mastered after employment. It is recommended to study additional professional programs in the field of pedagogical activity at least once every three years. "

The professional standard of the teacher of additional education in 2016 regulates the activities of the employee until 01.01.2017.From the beginning of next year, different norms will begin to apply.

Professional standard: the need for implementation


The Ministry of Justice of the Russian Federation has developed a professional standard due to the difficulties that have arisen in the process of determining the qualifications of a teacher. Some of the legislation was passed over 20 years ago. They are no longer relevant. To meet global trends, new standards are being introduced.

The norms adopted at the legislative level will help to increase the responsibility and interest of employees. To ensure that they are fully implemented, it is recommended to send employees to refresher courses.

According to the professional standard, a teacher is obliged to:

  • Select children for training according to the developed program (together with the commission).
  • Motivate learners.
  • Develop measures to improve the equipment of the classroom.
  • Prepare required communication materials.
  • Advise children and their parents.
  • Help students, control them.
  • Correct the behavior of children.
  • Understand the needs of students.
  • To recruit groups of students, taking into account the peculiarities of educational programs.
  • Ensure the safety and correct use of consumables, equipment, etc.
  • Create comfortable conditions for the development of children.
  • Prepare students to participate in competitions, exhibitions and other similar events.
  • Create conditions for the development of self-esteem and self-control in children.
  • Collaborate with colleagues, maintain a supportive atmosphere.

In order for the educational process to proceed according to the standard and at the same time in an unconventional way, the teacher of additional education must have the following personality traits:

  • High intellectual level.
  • Awareness of the needs of children.
  • Sense of humor.
  • High creativity.
  • Sensitivity.
  • Tolerance of beliefs.

According to the changes introduced this year to the Federal Law No. 273 "On Education in the Russian Federation" in 2017, each teacher of additional education must pass compulsory certification. This procedure shows the degree of skill of the employee. The pedagogical worker must necessarily provide evidence of his achievements: thanks, letters, diplomas. Based on the results of certification, he is assigned one or another qualification category. The result of the certification can be challenged in court. Also, a special labor commission can be created to resolve the issue.

The minor changes that happened in 2016 are not problematic. Everything is clear and doable. Heads of centers and municipal institutions for additional education for children should prepare by January 1, 2017. The professional standard will enter into force, on which depends not only the level and, as a result, the result of the work of teachers, but also their earnings.
